GDPR, ePrivacy and consent management

Consent management is central to how you collect and activate data, from marketing steering to strategic decisions. Three frameworks meet on this subject, the GDPR, the ePrivacy Directive and the CNIL guidelines, and it has a direct effect on your campaigns.

We help you define your consent strategy, together with your Legal, IT and Business teams, then configure the tools that carry it: your Consent Management Platform and Google Consent Mode.

EdgeAngel is a data marketing and AI agency, and an independent consultancy. We frame your consent strategy and configure your tools, or we work alongside your internal teams and your DPO.

Two-part diagram. First part, strategy: the Legal, Business and IT teams jointly decide the consent rules, meaning the purposes, the vendors, the legal bases and the behaviour expected of each tag. Second part, implementation, in four numbered steps: the CMP that carries the banner and the TCF vendor list and collects the choice, the signal that makes that choice usable by the tools through Consent Mode and the TC String, the behaviour of each tag which can be exempt and fire without consent, conditional and wait for the signal, or degraded and fire without identifiers, and finally the analytics and advertising destinations that each receive what they were allowed

Our approach

Our consent and compliance expertise

01

Consent strategy

  • Audit of your trackers: cookies, local storage, SDKs, and the data flows leaving your website and your apps
  • Mapping of purposes and vendors, worked through with your Legal, IT and Business teams
  • CMP selection based on your context: web and app scope, integrations, multi-domain governance, and the teams who run it day to day
  • Banner design and the trade-offs it creates on your consent rate
  • The legal framework stays with you, with your DPO or your counsel. We handle the technical and marketing decisions that follow from it
02

CMP, Consent Mode and tag sequencing

  • CMP configuration: banner, vendor list, retention periods, consent withdrawal
  • TCF framework for programmatic advertising, on web and in apps
  • Google Consent Mode v2, in Basic or Advanced mode, and what each one implies for your conversion reporting
  • Tag behaviour and sequencing: exempt, conditional on the signal, or degraded, tag by tag. The leading cause of measurement and attribution gaps
  • Testing the setup, scenario by scenario, before and after go-live
03

Durable collection and governance

  • Server-side tracking (sGTM): control over what reaches each partner, and filtering before sending
  • First-party data and enhanced conversions, respecting the choices your users made
  • Measurement on refusal: modelling, aggregate measurement, analytics solutions that can be configured without consent
  • Ongoing monitoring: consent rate, gaps between your tools, alerts when a tag changes behaviour

Our method

How we work

A consent project is decided before it is configured. We start by recording what actually happens on your sites and apps, then we bring together the people who have to decide.

More about the agency
  1. 01

    Record

An inventory of the trackers, vendors and tags in place, on every domain and every application. A factual baseline, before any discussion.

  2. 02

    Frame

A workshop with your Legal, IT and Business teams: the purposes you keep, the vendors you keep, and the behaviour expected of each tag.

  3. 03

    Deploy

Configuration of the CMP, Consent Mode and the behaviour of each tag, then testing scenario by scenario before go-live.

  4. 04

    Monitor

Tracking of consent rates and of the gaps between your tools. A new tag or a banner redesign can change the setup without warning.

We work on full framing, one-off audits, or in support of your internal teams and your DPO.

FAQ

Frequently asked questions about consent

Why work with a consultancy when the CMP is already a tool?

Because the tool carries out a decision it does not make for you.

A consent management platform can display a banner, store a choice and pass it on to your tools. What remains to be decided is the purposes you declare, the vendors you keep, the behaviour each tag receives, and what all of that produces for your measurement.

We are the trusted third party between you and the vendor: we work those decisions through with your teams, we configure the tool, and we check on the ground that the result matches what was decided.

Who needs to be in the room to frame a consent setup?

Three parties, and each holds a piece the other two do not have.

  • Legal, or your DPO: purposes, legal bases, retention periods, documentation of the setup.
  • IT: technical integration, script loading order, page performance, application environments.
  • Business and acquisition: what the setup changes for measurement, attribution and campaign steering.

Our role is to hold the three together, in language each of them understands, and to surface the trade-offs rather than settle them on our own.

How do you choose a CMP?

On your context, not on a ranking.

The criteria that really make a difference: the scope to cover (website, mobile apps, connected TV), integrations with your existing stack, handling of multiple domains or brands, TCF support if you run programmatic advertising, Google certification if you rely on its tools, and how easily your teams can run it day to day.

We work across every platform on the market, OneTrust, Axeptio, Commanders Act, Usercentrics, Cookiebot or Didomi, where we are a Gold partner. The choice is made on your side.

What is Consent Mode, and what does it change for my campaigns?

It is the mechanism that passes your visitor's choice on to Google tools, rather than simply blocking tags.

It comes in two modes. Basic holds tags back until consent is given. Advanced sends a signal without identifiers when a user refuses, which lets Google model part of the conversions it cannot observe.

What it changes depends on your volume, your consent rate and how your tags are sequenced. That is why we measure the effect on your own account rather than quoting an average gain.

Why do my consent rates differ from one tool to another?

Almost always because the tools are not counting the same thing, at the same moment.

  • Sequencing: some tags fire before the consent signal is available. They count visits the others ignore, and the gap then shows up in attribution.
  • Scope: a CMP counts banner displays, an analytics tool counts sessions, an advertising platform counts events. Three different denominators.
  • Exemptions: measurement configured to run without consent sees a population the other tools never see.

Diagnosing those gaps is a large part of the work, and it is often where we start.

What happens to measurement when a user refuses?

It changes in nature: it becomes aggregate or modelled instead of individual.

Several levers combine depending on the case: the conversion modelling offered by the platforms, an analytics solution configured to run without consent, and measurement methods that do not rely on identification, such as incrementality tests or contribution models.

What matters is knowing what each figure covers before steering with it, and saying so to the teams who use it.

GDPR, ePrivacy, CNIL: which one says what?

Three frameworks that overlap on the same subject.

  • The GDPR is the European regulation on the processing of personal data. It sets the principles: purposes, legal bases, rights of individuals.
  • The ePrivacy Directive, transposed into French law, governs access to information stored on a user's device. That is what covers cookies and other trackers.
  • The CNIL is the French authority. It publishes guidelines and a recommendation on trackers, which set out its operational reading of those texts.

This framework moves, and so does its interpretation. Our job is to keep your setup current on the technical and marketing side, with your DPO or your counsel on the legal reading.

Does server-side tracking change anything about consent?

It changes what you control, not the rule that applies.

Consent remains the condition for firing, and a tag server placed between your site and your partners does not replace it. What it brings is elsewhere: you see and decide what reaches each recipient, you filter out unnecessary data before sending, and you lighten what runs in the browser.

It is a governance gain, and it calls for even more rigour on carrying the consent signal all the way to the server.
